CONSENT TO ELECTRONIC DELIVERY OF DISCLOSURES AND COMMUNICATIONS

 

This Consent to Electronic Delivery of Disclosures and Communications (“Consent”) applies to all communications, documents, disclosures, and other information related to the services provided by TNC Communications and its affiliates or agents (“Company” or “TNC”) to you (“Customer” and “you” or “your”). TNC Communications is permitted under the federal E-SIGN Act and other applicable law to provide you written notices, disclosures or contracts electronically with your consent, which may be given by your electronic signature, via mouse-click or finger-tap on the “I agree” checkbox associated with an order or agreement on your account;

  1. Scope of Consent: By agreeing to this Consent, Customer consents to receive all communications, documents, disclosures, and other information related to the services provided by Company in electronic form, including but not limited to: a. Service agreements, terms and conditions, and policies; b. Billing statements, invoices, and payment information; c. Service announcements, updates, and notifications; d. Legal and regulatory notices and disclosures (collectively, “Electronic Records” or “Documents”).
  2. Method of Delivery: Company may provide electronic communications to you through various methods, including but not limited to email, text message, or by posting the information on Company’s website or customer portal. Customer is responsible for providing and maintaining a valid email address and/or mobile phone number for electronic delivery purposes. Once we make the Documents available they will govern your relationship with TNC.
  3. TNC’s Option to Send Paper: Your consent does not mean that TNC must provide all Documents electronically. TNC may, at its option, deliver Documents to you in paper form. TNC may also require that certain communications from you be delivered to TNC on paper at a specified address.
  4. Hardware and Software Requirements: To access and retain electronic communications, Customer will need a device with internet access, a valid email address and/or mobile phone number, and a web browser or email client software capable of displaying HTML-formatted emails and PDF files.
  5. Withdrawal of Consent: Customer may withdraw consent to electronic delivery at any time by contacting Company’s customer service by email at [email protected]. Upon withdrawal of consent, Company will provide future communications, documents, disclosures, and other information in paper form. Withdrawal of consent will not affect the legal validity and enforceability of electronic communications provided prior to the withdrawal. Additionally, you may view copies of the respective policy, terms of service, message, notice, or disclosure presented to you in full or as accessed by website link at the time you access or are viewing them on your computer.
  6. Paper Copies: Customer may request a paper copy of any electronic communication by contacting TNC’s customer service at [email protected]. Where permitted by law, there may be a fee for a paper copy of the Documents following your receipt of an electronic copy of the Documents. This fee may be up to $5.00 per request. Any applicable fee will be disclosed to you at the time of your request for a paper copy of the Documents.
  7. Updating Contact Information: Customer is responsible for promptly updating Company with any changes to Customer’s email address, mobile phone number, or other contact information and to regularly check for electronic communications from Company. Company shall not be liable for any failure to deliver electronic communications due to Customer’s failure to provide and maintain accurate contact information and/or due to factors beyond Company’s control, including by not limited to technical failures, or communications being blocked or filtered as spam.
  8. Customer’s Notices: Except as otherwise provided in this or other agreements, by law, or on our website, you cannot give us notices electronically, and all notices from you must be in writing.
  9. Termination/Changes: We reserve the right, at our discretion, to discontinue the provision of electronic Documents. We will provide you with notice of any such termination or change as required by law.

 

By agreeing to this Consent, Customer acknowledges that they have read, understood, and agree to the terms and conditions outlined above, and consent to receive electronic delivery of disclosures and communications related to the services provided by Company.
